BCDA offers legal remedies to CJHDevCo sub-lessees in Camp John Hay

BAGUIO CITY, Philippines – The Bases Conversion and Development Authority (BCDA) has stepped up efforts to assist sub-lessees of CJH Development Corporation (CJHDevCo) in Camp John Hay, offering legal guidance and opportunities to transition into new lease agreements following the Supreme Court ruling that mandated the full return of the 247-hectare property to the government.

BCDA Chairperson Hilario Paredes reaffirmed the agency’s commitment to ensuring a fair resolution for those affected by the high court’s decision. The ruling upheld the 2015 Arbitral Award, which voided CJHDevCo’s lease and ordered that all improvements and permanent structures within Camp John Hay be turned over to BCDA.

“We recognize the emotional, financial, and legal challenges faced by those affected by the Supreme Court ruling,” said Paredes. “BCDA’s goal is to help them navigate these issues and ensure that their rights are protected and exercised.”

BCDA has been actively assisting sub-lessees by explaining the legal implications of the Supreme Court ruling and outlining potential remedies. The agency has urged sub-lessees to pursue claims directly against CJHDevCo or the parties that sold or assigned their leases, emphasizing that BCDA was never a party to their agreements.

To further aid in the transition, BCDA has been working closely with the ex-officio sheriff of the Baguio Regional Trial Court (RTC) to implement the final ruling in an orderly manner.

The Supreme Court’s April 2024 decision reversed a 2015 Court of Appeals ruling that had previously invalidated the Writ of Execution and Notice to Vacate issued by Baguio RTC Branch 6. With this reversal, the sheriff was directed to ensure that CJHDevCo, along with all individuals and entities claiming rights under it, vacate the leased premises and turn over all improvements to BCDA.

Acknowledging the diverse demographics of Camp John Hay residents, BCDA is also extending humanitarian support, including temporary hotel accommodations for affected foreign nationals. Translation services are being provided to ensure clear communication throughout the legal process.

At the same time, BCDA is negotiating new lease terms with sub-lessees to facilitate a smooth transition. Over 40 new lease agreements have already been signed in residential areas such as Forest Estates, Country Homes, Golf Estates, and Forest Cabins. Talks are ongoing with other sub-lessees to establish fresh lease arrangements that align with BCDA’s plans for Camp John Hay’s redevelopment.

BCDA has reiterated its openness to dialogue and encouraged affected sub-lessees to reach out to its help desk to discuss their legal standing and explore possible solutions within the bounds of the law.
